Inbytte problem

Hi, sorry not good at my Norwegian, but I have a problem with a car I innbytte for a new car with a dealer.

 

When I signed the contract they put in a part that said "innbytte bil forbehold om feil og mangel teknisk" The dealer didn't do a full technical check of the car and now we've changed cars and money paid.

 

The dealer has come back and said there are technical faults with my old car and is demanding kr 15000 for it to be fixed.

 

Are they allowed to do this? I know some of it is rubbish as they are claiming for new tyres (changed them last summer...)

 

I gave them the car believing there was nothing wrong with the car, it was serviced 6 months ago and I had alot of work done to it.

 

Help anyone???

Tell them you are a member of http://www.naf.no (AAA/ADAC) and want NAF to control the car. If they don't wanna do that, say they will hear from your NAF lawyer. If you are or become a member they will provide you a real lawyer for free. :)

 

Anyway this is a unwise contract and you may have screwed yourself if it's legal.

Well, I've replied to the dealer with my complaints on his "bug list" which half of which is ridiculous (window wipers, frostvæske and tyres) the other half I can't check.

 

Told them I don't have that kind of money and that basically I think it's wrong that he can charge whatever he wants and therefore the whole contract is no longer valid as this is now a deal different from the one I signed.

 

So the way I see it there's 2 options,

1. be reasonable about it, reduce the price and deduct the value of the winter wheels I gave him that weren't in the contract

 

or

 

2. give me my car and money back and I'll give him his car back because I'm not paying that

 

Just hope it all works out....
